Recently cited by one of the leading authorities on civil discovery issues, the Guidelines focus on defensible TAR workflows, whether counsel should disclose its use of TAR, and the merits of entering into a stipulated TAR use protocol. The 2016 Guidelines expand on various aspects of these issues to help outside counsel, in-house lawyers, and judges gain a better understanding of the burgeoning use of TAR.
